Terms of sale
These terms apply when you buy a license for software published under the x-doo name, such as VizWave. The seller and licensor is Nenad Karalić, a private individual from the Republic of Serbia. "x-doo" is a brand name, not a separate company. The license you buy is a contract between you and Nenad Karalić; the payment is handled by Paddle.com, as described in section 3.
By buying a license, or by using the software or this website, you agree to these terms. If you don't agree, please don't buy or use them.
1. What you buy
You buy a license to use the software, not the software itself. What you may do with it is set out in the software's license agreement (for VizWave: the VizWave license agreement), which you accept when you install the software.
2. Ownership
The software is licensed, not sold. Nenad Karalić keeps all rights, title and intellectual property in the software, this website and everything included with them, except third-party components, which keep their own licenses. Rights not expressly granted are reserved.
3. Prices and payment
Prices are shown on the product page and are one-time payments, not subscriptions. Taxes such as VAT are added where required and shown at checkout. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle takes the payment, issues the receipt and invoice, collects taxes and processes refunds; questions about the software and your license go to me. Paddle's buyer terms also apply to the payment.
4. Delivery
The license is sent by email to the address given at checkout, usually within one business day. Check your spam folder; if nothing has arrived after two business days, write to vizwave-support@x-doo.com.
5. Updates
Each license includes one year of updates from the day it is issued. Versions released in that year can be used without a time limit. A renewal for another year of updates is optional.
6. Free edition
The free edition can be used to try every feature before buying. Features of paid editions add a watermark until the matching license is entered.
7. Acceptable use
You may not use the software, your license or this website:
- for anything unlawful, or to help others break the law;
- for fraud, spam, or buying with payment details that aren't yours to use;
- to infringe other people's copyright, trademarks or other rights, for example by publishing videos with music or pictures you have no right to use;
- to attack or interfere with this website or the license service, for example with malware, probing for weaknesses, overloading it or scraping it.
8. Your content and other people's rights
The audio, images, videos and text you put into VizWave stay yours, and so do the videos you make with it. You are responsible for having the rights to everything you use and publish. VizWave runs on your computer; I don't host, see or publish your videos.
If you believe that material on this website or included with the software (such as templates, backgrounds, clip art or sample audio) infringes your rights, write to vizwave-support@x-doo.com with the material, the rights you hold and your contact details. I will look into it promptly and remove the material if the claim is justified. The same address can be used to report a VizWave license that is used to infringe others' rights.
A license whose holder repeatedly or seriously uses the software to infringe other people's rights may be ended under section 10.
9. No guarantee
I work to keep the software and this website reliable, but I can't promise that they will always be available or free of errors. To the extent the law allows, they are provided "as is", as set out in the license agreement. This doesn't limit your rights as a consumer under mandatory law.
10. Suspension and termination
I may refuse or cancel an order, or end a license, in case of a material breach of these terms or the license agreement, non-payment or a chargeback, a fraud or security risk, or repeated or serious violations. An ended license may no longer be used and may be blocked in later versions of the software.
11. Refunds
Every feature can be tried in the free edition before you buy, and a license is delivered as soon as you pay, so licenses aren't refunded because you changed your mind. You get a full refund within 14 days of purchase if the license doesn't work and support can't fix it, if you paid twice, or (instead of an exchange) if you bought the wrong edition, as described in the refund policy. Under Paddle's buyer terms, the 14-day right of withdrawal for digital content ends once you have started to download or use the software. Your rights as a consumer under mandatory law, such as for faulty software, are not limited by these terms.
12. Contact
Questions about a purchase, a license or the software: vizwave-support@x-doo.com. Postal address: available on request by email.
13. Governing law
These terms are governed by the laws of the Republic of Serbia. Mandatory consumer protection rules of your country of residence still apply.
