VizWave license agreement
Please read this agreement before installing or using VizWave ("the Software"). By installing, copying or using the Software you agree to these terms. If you do not agree, do not install or use the Software.
1. Editions
The Software comes in three editions: Free, Pro and Studio. The Free edition may be used without payment. Videos made with it carry a small "Made with VizWave" mark, and features that belong to a paid edition add a watermark to the video. A paid license (Pro or Studio) removes these marks for the features of its edition.
2. License
- Free edition: the Licensor grants you a free, non-exclusive, non-transferable license to install and use the Software, for personal or commercial purposes, with the marks described in section 1.
- Paid editions: on payment of the license fee, the Licensor grants you a non-exclusive, non-transferable, perpetual license to use the edition you bought. The license is issued to one person, named in the license (if an organization buys it, to the one person who will use it). That person may install the Software on all computers they own or use, but the license may not be used by other people.
- Videos and other output you create with the Software belong to you.
3. License Key And Updates
- A paid license is a license key (a text or a .vizlicense file) sent to the e-mail address given at purchase. It works offline; the Software does not need an internet connection and does not send your data anywhere.
- A license includes one year of updates from the date it was issued. It works with all versions of the Software released during that year, and you may keep using those versions without time limit. Versions released later need a renewed license, which is optional.
- Keep your license key private. A key that is shared with others or published may be blocked in later versions of the Software.
4. Restrictions
You may not, except as permitted by applicable law or by the licenses of the third-party components listed in section 7:
- sell, rent, lend, sublicense or otherwise give the Software or your license key to others;
- remove, hide or work around the license checks, marks or watermarks, or make or use license keys not issued by the Licensor;
- modify, decompile, disassemble or reverse engineer the Software;
- remove or alter any copyright or license notices in the Software.
5. Refunds
You can try every feature in the Free edition before buying. If a paid license does not work for you, write to vizwave-support@x-doo.com within 14 days of purchase for a refund. This does not limit your rights as a consumer under mandatory law.
6. Ownership
The Software is licensed, not sold. The Licensor keeps all rights, title and interest in the Software, including all copyrights. Rights not expressly granted in this agreement are reserved.
7. Third-Party Components
The Software includes components owned by third parties, such as FFmpeg (LGPL 2.1), libvpx, SVT-AV1, libaom, Opus and many open-source Rust libraries. They are licensed to you under their own licenses, which are installed with the Software (the "ffmpeg\licenses" folder and THIRD-PARTY-LICENSES.txt). Nothing in this agreement limits your rights under those licenses. The FFmpeg source code is available at https://ffmpeg.org/releases/.
8. Audio, Images And Fonts You Use
You are responsible for having the rights to the audio, images, fonts and other material you use with the Software and to the videos you publish. The clip art, backgrounds, templates and sample audio included with the Software may be used in videos you make with it.
9. No Warranty
To the extent permitted by applicable law, the Software is provided "as is", without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
10. Limitation Of Liability
To the extent permitted by applicable law, the Licensor is not liable for any indirect, incidental, special or consequential damages, or for loss of data, profits or business, arising from the use of or inability to use the Software. The Licensor's total liability is limited to the amount you paid for the Software. Nothing in this agreement limits liability that cannot be limited by law, or your rights as a consumer under mandatory law.
11. Termination
This license ends automatically if you breach its terms. You must then stop using the Software and delete all copies.
12. Governing Law
This agreement is governed by the laws of the Republic of Serbia. Mandatory consumer protection rules of your country of residence still apply.
13. Entire Agreement
This is the entire agreement between you and the Licensor about the Software. If a provision is found unenforceable, the rest remains in effect.
